These Terms and Conditions (“Terms”) govern your access to and use of the Moibook platform, mobile applications, and related services (collectively, “Services”).
By using Moibook, you agree to comply with and be bound by these Terms. If you do not agree, please discontinue use of our Services immediately.
Definitions
“Moibook” refers to the digital platform, software, website, and mobile apps operated by us.
“User,” “You,” or “Your” means any individual or entity accessing Moibook, including event organizers, guests, volunteers, or staff.
“Organizer” refers to a user creating, managing, or promoting an event on Moibook.
“Guest” means an individual invited to, attending, or participating in an event hosted on Moibook.
“Event” refers to any gathering, program, or campaign created and managed via Moibook.
Eligibility
To use Moibook, you must:
Be at least 18 years of age or have legal capacity in your jurisdiction.
Provide accurate and verifiable information during registration.
Use Moibook in compliance with all applicable laws, including data protection, taxation, and financial transaction regulations.
Organizers must ensure that events and collections comply with local fundraising, tax, and data protection rules.
Services Provided
Moibook provides tools and technology to:
Create and publish events with public page.
Collect and manage moi (donation) payments online and offline
Issue and verify event passes (QR-based, with offline capability)
Manage guest lists and invitations
Send notifications via WhatsApp, SMS, email, and push
Access dashboards, analytics, and downloadable reports
Store event media (photos, videos) and conduct live streaming
Support multi-event management for organizations and institutions
We may enhance or modify our services over time, and such changes will be notified on our website or via email.
User Responsibilities
To use the platform only for lawful purposes.
Not to upload or distribute harmful, abusive, defamatory, or infringing content.
To maintain the confidentiality of your login credentials.
To obtain valid consent before sharing any personal or contact details of guests or donors.
Not to attempt unauthorized access, reverse-engineering, or disruption of Moibook’s systems.
To comply with all applicable payment, donation, and data privacy laws.
Organizers are solely responsible for the accuracy of event information, donations collected, and guest communication.
Payments, Fees & Refunds
All payments and donations are processed through secure third-party payment gateways (e.g., UPI, credit/debit cards, net banking).
Moibook charges notification service fees (e.g., ₹ 0.5 per WhatsApp/SMS notification) and may introduce additional fees for premium features, which will be transparently displayed before payment.
Successful and failed transactions will be notified to users via SMS, WhatsApp, or email.
Refunds, if applicable, are subject to organizer discretion and the respective payment gateway’s policies.
Moibook is not a financial intermediary and holds no responsibility for payment disputes between organizers and guests.
Organizers are responsible for all applicable taxes or deductions arising from the use of Moibook services.
Content Ownership and Intellectual Property
a) User-Generated Content
You retain ownership of any content (media, text, event details) you upload.
By uploading, you grant Moibook a non-exclusive, royalty-free, and revocable license to use, store, and display such content solely for providing services.
b) Moibook Intellectual Property
All Moibook software, design, features, trademarks, logos, and documentation remain the exclusive property of Moibook.
You may not copy, reproduce, modify, distribute, or use Moibook’s branding without prior written permission.
Communication and Notifications
By using Moibook, you consent to receive transactional, service, and event-related messages via WhatsApp, SMS, email, or push notifications.
Each WhatsApp/SMS notification may be subject to applicable usage fees as stated in the pricing policy.
You may opt out anytime by replying STOP or contacting Info@moibook.in.
Moibook will not send promotional or marketing content without your explicit consent.
Platform Availability
We strive for 99.9% uptime, but service interruptions may occur due to maintenance, updates, or technical issues.
Moibook does not guarantee continuous availability and is not liable for loss of data or revenue during downtime.
We may suspend or limit certain services temporarily for upgrades or compliance purposes.
Account Suspension and Termination
a) Moibook reserves the right to suspend, restrict, or terminate your account without prior notice if:
You violate these Terms or applicable laws
You upload harmful, fraudulent, or illegal content
You misuse the platform to send spam or conduct unauthorized fundraising
You engage in activities that threaten platform security or reputation
Upon termination:
Access to your account and data may be revoked
Some data may be retained as per legal requirements or for dispute resolution
Limitation of Liability
To the fullest extent permitted by law:
Moibook shall not be liable for any indirect, incidental, or consequential damages (including loss of data, revenue, or goodwill).
Moibook does not guarantee event attendance, engagement, or donation outcomes.
All event-related or financial disputes are strictly between the organizer and the guest.
Indemnification
You agree to indemnify, defend, and hold harmless Moibook, its affiliates, officers, and employees from any claims, damages, liabilities, or expenses arising from:
Your use or misuse of the platform
Violation of these Terms or applicable laws
Infringement of third-party rights through content or conduct
Privacy and Data Protection
Your use of Moibook is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information.
By using Moibook, you also agree to the terms of our Privacy Policy available at https://moibook.in/privacy-policy.
Compliance with Laws
You agree to comply with all applicable local, state, and national laws, including:
Digital Personal Data Protection (DPDP) Act, 2023
Information Technology Act, 2000 and related rules
Taxation, payment, and anti-money laundering regulations (RBI, NPCI, etc.)
Organizers collecting funds must ensure proper compliance with relevant donation or contribution laws.
Force Majeure
Moibook shall not be held liable for any delay or failure to perform its obligations resulting from events beyond its reasonable control, including natural disasters, internet outages, government restrictions, cyberattacks, or labor disputes.
Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India.
Disputes shall be subject to the exclusive jurisdiction of the courts located in Ramanathapuram, Tamil Nadu.
Where possible, parties shall first attempt to resolve disputes through good-faith negotiation or mediation before seeking legal remedies.
Modifications to the Terms
Moibook reserves the right to amend or update these Terms at any time.
Significant changes will be communicated via email, in-app notice, or website update.
Continued use of Moibook after such changes constitutes your acceptance of the revised Terms.
